Welcome to Popularoo! These Terms of Service ("Terms") govern your use of the Popularoo mobile application ("App", "Service"). By accessing or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the Popularoo app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the App.

2. Eligibility

• You must be at least 12 years old to use this App
• If you are under 18, you must have parent/guardian permission
• You must comply with all local laws regarding online conduct
• You must not be prohibited from using the Service under any applicable law

3. Description of Service

Popularoo is a social rating platform that allows users to:

• Vote (like/dislike) on public personalities
• View real-time popularity scores and rankings
• Track voting trends and statistics
• Purchase premium credits for enhanced voting power
• Add new personalities to the platform

4. User Conduct and Rules

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in a respectful manner. You will NOT:

• ❌ Use bots, scripts, or automated tools to manipulate votes
• ❌ Create multiple accounts to artificially inflate or deflate scores
• ❌ Harass, threaten, or defame any person or personality
• ❌ Post offensive, hateful, or discriminatory content
• ❌ Attempt to hack, breach, or compromise the App's security
• ❌ Spam or flood the system with excessive requests
• ❌ Impersonate any person or entity
• ❌ Violate any intellectual property rights

4.2 Vote Manipulation

We have zero tolerance for vote manipulation. Actions that may result in immediate account termination include:

• Using automated voting systems
• Coordinating mass voting campaigns
• Exploiting bugs to gain unfair advantages
• Purchasing votes from third parties

5. User-Generated Content

5.1 Adding Personalities

When you add a new personality to the platform, you agree that:

• The person is a public figure or has public relevance
• The name is accurate and not misleading
• You are not violating anyone's privacy or rights
• The submission is not spam or duplicate content

5.2 Content Moderation

We reserve the right to:

• Review and approve/reject any personality submission
• Remove personalities that violate our guidelines
• Moderate content without prior notice
• Take action against users who abuse the system

6. Premium Features and Payments

6.1 Credit Purchases

You may purchase credits ("Boosters") to enhance your voting power:

• Booster: 100 votes for €0.99
• Super Booster: 1000 votes for €4.99

6.2 Payment Terms

• All purchases are processed through Apple App Store or Google Play Store
• Prices are in Euros and may vary by region
• Payments are final and non-refundable except as required by law
• We do not store your payment information

6.3 Refund Policy

Refunds are handled by Apple or Google according to their policies:

• Android: Google Refund Policy

6.4 Credits Usage

• Credits do not expire
• Credits are non-transferable between accounts
• Credits have no cash value and cannot be exchanged for money
• We may adjust credit costs with 30 days notice

7. Intellectual Property

7.1 Our Rights

All content, features, and functionality of the App are owned by Popularoo and protected by copyright, trademark, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

7.3 Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for commercial purposes without permission

8. Disclaimers

8.1 "As-Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8.2 No Endorsement

Scores and rankings on Popularoo reflect user votes and DO NOT represent our opinions or endorsements of any personality.

8.3 Accuracy

We strive for accuracy but do not guarantee that:

• Scores are 100% free from manipulation
• All personalities are correctly categorized
• The App will be error-free or uninterrupted
• Data will always be available or accurate

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the last 12 months (if any)
• We are NOT responsible for damages arising from: use or inability to use the App, unauthorized access, data loss, or third-party actions

10. Indemnification

You agree to indemnify and hold harmless Popularoo, its owners, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person
• Your misuse of the App
• Content you submit to the platform

11. Termination

11.1 By You

You may stop using the App at any time by uninstalling it from your device.

11.2 By Us

We may suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Prolonged inactivity
• Any reason at our sole discretion

11.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Your local data remains on your device until deleted
• Unused credits may be forfeited (no refunds)
• Server data may be deleted after 30 days

12. Modifications to Service and Terms

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

12.2 Terms Changes

We may update these Terms from time to time. Changes will be effective when posted. Your continued use constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of France. Any disputes shall be resolved through:

• Good-faith negotiation

• Binding arbitration or courts of France (as a last resort)

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Popularoo regarding the use of the App.
